Terms of Service

General

I will make all of these commissions to fit your request as best as I can. Everything will have to fit within my existing styles and experiences, otherwise I can't guarantee the result to be fit to your expectation. I reserve the right to refuse a project that I feel I cannot complete sufficiently, due to the nature of the work requested, or for any other reason(s) unspecified.

Rights

Please reach out if you feel like you would rather settle with a contract, in the case you wish to deviate from the terms in the Rights section (rev-split for release/collab-like productions). I reserve the right to share (non-NDA) WIPs + completed commissions on social media sites and/or my portfolio. If you would like to share sketches or unfinished works outside of our private conversations, please ask first.For any work involving the creation of derivative content (such as covers and remakes) I am not responsible for any copyright infringement that may occur. Please ensure that you have secured all licensing rights to create and redistribute such content.Intelectual property (NOT applicable for "Cover/Remake" type)
I retain the full rights to the commissioned work, including the right to upload them to my own sites/socials/portfolio, commercially or non-commercially for the purpose of showcasing my work. If you're looking to purchase full rights to the composition and recording, please contact me and we can discuss options. Copyright belongs to me, and the client will have the exclusive right to use the finished product on their own social media accounts (limited commercial use). You ARE ALLOWED to use the music in a Youtube video or Twitch livestream. Commercial usage such as monetization and uploading to streaming services is a violation of these terms and is NOT allowed. This includes usage of the works in a derivative work that generates revenue, or posts that have the sole purpose of generating revenue by using the commissioned work.Credits
When the client makes use of their right to show the finished commission on their account on a media outlet or streaming platform, they are obligated to give simple credit to me, the creator. The bare minimum is fine. So for example as little as a link to https://tobyoshi.to or tagging me on that respective platform will suffice. (Simple NDA)
Your username and what you commissioned will show up in my Commission Tracker on Trello, and works may be shared during, or past the commission process. If you would like to be exempt from the the Trello board, and possible progress being shared, you can request a "surprise-fee" for an additional 50% of the final price. This will only last until the final version is accepted, and you still have to credit me after completion.(Persistent NDA)
If you would like to completely hide the fact that you commissioned me, even after completion, you can request a "secrecy-fee" for an additional 50% of the commission price. This is until a given date you choose.If you would like something more official for complete confidentiality - not needing to credit me, and I am not allowed to share progress and the finished work of the commission - you will need to set up a separate Non-Disclosure Agreement with me. Please reach out privately so discuss this.

Payment

ALL PAYMENT GOES THROUGH VGEN. Prices will vary depending on the request, and are subject to change at any time. Full payment upfront is expected. However, it is also fine to request to pay only 50% of the final price before the start of the commission, and the rest after the first sketch is accepted. Prices are given in Euros, and automatically converted through VGen to display in YOUR local currency. All prices and payments are further handled by VGen's Policy. If you offer commissions yourself, you can offer to pay for the commission with a commission (like an art-trade).Refunds
If the commission is canceled for whatever reason, the client forfeits any and all rights to the commissioned work. Refunds will ONLY be issued for 50% and ONLY IF the refund is requested before the sketching phase is completed - when the sketch is accepted, and we move on to the next phase. After the sketch is accepted, refunds are not allowed. For Skeb-style commissions, there are no refunds possible at all.

Delivery

Revisions (NOT applicable for "BGM (Skeb/no revisions)" type)
Each client gets up to 3 free revisions in that first month since the first draft was sent to the client. No free revisions will be given after that 1 month since the first draft was sent. With every revision I make a little "Change-log" video to update you and point out what's different in what I changed. During communication with me (before payment), by mentioning the words "chocolate chip cookie" you get a five buck discount as a 'treat' for reading through my Terms of Service.Deadline
The estimated delivery times given in each of the commission descriptions are rough estimates, so if you have a hard deadline for something, it is up to you to mention it to me. Rush delivery will incur in additional fees depending on the type of service requested.Progress

Communication

Communications can be carried over E-mail or Discord at the client's preference. Commissions are digital files only, no physical goods will be received. The files will be provided to you via a Google Drive link over email, Discord, or Twitter, depending on previous methods of communication. Updates will come in the form of a "change-log" type video.
